A na co si d\u00e1t zvl\u00e1\u0161\u0165 pozor?<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-normal-font-size\">1.&nbsp; Nebojte se pr\u00e1vn\u00edk\u016f<\/h2>\n\n\n\n<p>Pokud jste ve sv\u00e9m \u017eivot\u011b dosud nevyu\u017eili pr\u00e1vn\u00edch slu\u017eeb advok\u00e1t\u016f, je p\u0159i koupi nemovitosti ten spr\u00e1vn\u00fd \u010das to zm\u011bnit. Advok\u00e1t se s&nbsp;touto problematikou setk\u00e1v\u00e1 \u010dasto, a proto p\u0159esn\u011b v\u00ed, jak\u00e1 rizika mohou nastat. Bu\u010fte proto kriti\u010dt\u00ed k&nbsp;jimi prezentovan\u00fdm informac\u00edm o nemovitosti. V\u017edy trvejte na prohl\u00eddce nemovitosti a vyhra\u010fte si na ni dostatek \u010dasu. Zkoumejte a ptejte se \u2013 nen\u00ed na tom nic hloup\u00e9ho ani nevhodn\u00e9ho. M\u00e1te-li o nemovitost v\u00e1\u017en\u00fd z\u00e1jem, lze doporu\u010dit proveden\u00ed prohl\u00eddky i za \u00fa\u010dasti odborn\u00e9 osoby, kter\u00e1 dok\u00e1\u017ee zejm\u00e9na jej\u00ed stavebn\u011b-technick\u00fd stav l\u00e9pe posoudit.<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-normal-font-size\">3.&nbsp; Kde to m\u016f\u017eu podepsat?<\/h2>\n\n\n\n<p>I kdy\u017e divok\u00e1 devades\u00e1t\u00e1 l\u00e9ta m\u00e1me za sebou, st\u00e1le se v&nbsp;dne\u0161n\u00ed dob\u011b objevuj\u00ed na realitn\u00edm trhu praktiky, na kter\u00e9 je dobr\u00e9 d\u00e1t si pozor. Proto v\u017edy pe\u010dliv\u011b prostudujte v\u0161echny dokumenty, kter\u00e9 V\u00e1m realitn\u00ed makl\u00e9\u0159 (nebo kdokoliv jin\u00fd) d\u00e1v\u00e1 k&nbsp;podpisu a nenechte se do ni\u010deho tla\u010dit. I kdy\u017e se jedn\u00e1 \u201e<em>jen o protokol o prohl\u00eddce\u201c.<\/em>&nbsp;I v&nbsp;takov\u00fdch dokumentech se toti\u017e mohou skr\u00fdvat ujedn\u00e1n\u00ed o povinnosti k&nbsp;\u00fahrad\u011b smluvn\u00edch pokut a podobn\u011b.<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-normal-font-size\">4.&nbsp; LV nen\u00ed jen zna\u010dka kabelek<\/h2>\n\n\n\n<p>Evidence katastru nemovitost\u00ed obsahuje velmi u\u017eite\u010dn\u00e9 informace, kter\u00e9 byste m\u011bli zn\u00e1t, ne\u017e se ke koupi nemovitosti zav\u00e1\u017eete. Jde zejm\u00e9na o ov\u011b\u0159en\u00ed, \u017ee V\u00e1m prezentovan\u00fd vlastn\u00edk nemovitosti je i vlastn\u00edkem skute\u010dn\u00fdm, \u017ee na nemovitosti nev\u00e1znou \u017e\u00e1dn\u00e9 dluhy, exekuce, z\u00e1stavn\u00ed a jin\u00e1 pr\u00e1va t\u0159et\u00edch osob, kter\u00e9 by V\u00e1s jako budouc\u00edho vlastn\u00edka mohly z\u00e1sadn\u011b omezovat, p\u0159\u00edpadn\u011b by mohly znemo\u017enit i samotn\u00fd p\u0159evod nemovitosti do Va\u0161eho vlastnictv\u00ed.<\/p>\n\n\n\n<p>Aktu\u00e1ln\u00ed v\u00fdpis z&nbsp;katastru nemovitost\u00ed vztahuj\u00edc\u00ed se k&nbsp;nemovitosti by V\u00e1m m\u011bl p\u0159edat V\u00e1\u0161 realitn\u00ed makl\u00e9\u0159. Pokud tak neu\u010din\u00ed, zkontrolujte sami bezplatn\u011b alespo\u0148 z\u00e1kladn\u00ed \u00fadaje na webu \u010cesk\u00e9ho katastr\u00e1ln\u00edho \u00fa\u0159adu \u2013&nbsp;<a href=\"https:\/\/nahlizenidokn.cuzk.cz\/\">https:\/\/nahlizenidokn.cuzk.cz\/<\/a>. Je\u0161t\u011b lep\u0161\u00ed variantou v\u0161ak je obstarat si na p\u0159ep\u00e1\u017ece Czech point nebo u not\u00e1\u0159e za nevelk\u00fd poplatek tzv. LV (list vlastnictv\u00ed), ve kter\u00e9m naleznete ve\u0161ker\u00e9 podrobn\u00e9 informace o nemovitosti.<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-normal-font-size\">5.&nbsp; Kupn\u00ed smlouva nen\u00ed jen formalita<\/h2>\n\n\n\n<p>Samotn\u00e1 kupn\u00ed smlouva, p\u0159\u00edpadn\u011b smlouva o smlouv\u011b budouc\u00ed, je prakticky nejd\u016fle\u017eit\u011bj\u0161\u00edm dokumentem, kter\u00fd v&nbsp;souvislosti s&nbsp;koup\u00ed nemovitosti podepisujete. V\u011bnujte j\u00ed proto dostate\u010dnou pozornost. Pokud n\u011bkter\u00e9mu ustanoven\u00ed nerozum\u00edte, nebo s&nbsp;n\u00edm nesouhlas\u00edte, nechte si v\u0161e vysv\u011btlit, p\u0159\u00edpadn\u011b smlouvu nepodepisujte, nebudou-li zohledn\u011bny Va\u0161e p\u0159ipom\u00ednky a po\u017eadavky na jej\u00ed \u00fapravu, nebo nebude-li dostate\u010dn\u011b od\u016fvodn\u011bno, pro\u010d protistrana na navr\u017een\u00e9m zn\u011bn\u00ed trv\u00e1.<\/p>\n\n\n\n<p>Pokud podepisujete jak\u00fdkoliv dokument, ve kter\u00e9m se zavazujete kupn\u00ed smlouvu v&nbsp;budoucnu uzav\u0159\u00edt (nap\u0159. rezerva\u010dn\u00ed smlouvu nebo smlouvu o smlouv\u011b budouc\u00ed), m\u011bli byste u\u017e v&nbsp;tento moment zn\u00e1t p\u0159esn\u00fd obsah kupn\u00ed smlouvy. Jinak hroz\u00ed, \u017ee se dostanete pod tlak v&nbsp;dob\u011b, kdy V\u00e1m bude za neuzav\u0159en\u00ed kupn\u00ed smlouvy v&nbsp;navr\u017een\u00e9 podob\u011b hrozit smluvn\u00ed pokuta.<\/p>\n\n\n\n<p>Jak\u00e1koliv \u00fastn\u00ed dohoda m\u016f\u017ee sta\u010dit jen za p\u0159edpokladu, \u017ee ji i do budoucna v\u0161ichni z\u00fa\u010dastn\u011bn\u00ed dodr\u017e\u00ed. Pozd\u011bji lze jen t\u011b\u017eko prok\u00e1zat, \u017ee vz\u00e1jemn\u00e1 \u00fastn\u00ed dohoda byla odli\u0161n\u00e1 od t\u00e9 p\u00edsemn\u00e9.<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-normal-font-size\">6.&nbsp; Kdy a jak zaplat\u00edm?<\/h2>\n\n\n\n<p>Kupuj\u00edc\u00ed logicky nechce platit kupn\u00ed cenu, dokud nem\u00e1 jistotu, \u017ee nemovitost skute\u010dn\u011b z\u00edsk\u00e1 do sv\u00e9ho vlastnictv\u00ed a prod\u00e1vaj\u00edc\u00ed naopak nechce vlastnick\u00e9 pr\u00e1vo p\u0159ev\u00e9st, ne\u017e bude m\u00edt pen\u00edze na sv\u00e9m bankovn\u00edm kont\u011b. Co s&nbsp;t\u00edm? Nejlep\u0161\u00edm a pro ob\u011b strany bezpe\u010dn\u00fdm \u0159e\u0161en\u00edm je \u00faschova kupn\u00ed ceny. Slu\u017ebu \u00faschovy poskytuj\u00ed zejm\u00e9na advok\u00e1ti a not\u00e1\u0159i. Ve smlouv\u011b o \u00faschov\u011b kupn\u00ed ceny jsou pak p\u0159esn\u011b ujedn\u00e1ny podm\u00ednky a mechanismus \u00fahrady kupn\u00ed ceny do \u00faschovy a jej\u00ed v\u00fdplaty prod\u00e1vaj\u00edc\u00edmu. \u00dahrada kupn\u00ed ceny skrze \u00faschovu je v\u011bt\u0161inou preferov\u00e1na i ze strany banky financuj\u00edc\u00ed n\u00e1kup nemovitosti hypote\u010dn\u00edm \u00fav\u011brem.<\/p>\n\n\n\n<p>Jinak plat\u00ed stejn\u00e1 z\u00e1sada jako u kupn\u00ed smlouvy. U\u017e v&nbsp;okam\u017eiku podpisu prvn\u00edho dokumentu, ve kter\u00e9m se zav\u00e1\u017eete kupn\u00ed smlouvu v&nbsp;budoucnu uzav\u0159\u00edt, by m\u011bly b\u00fdt vyjasn\u011bny tak\u00e9 podm\u00ednky \u00faschovy. Ide\u00e1ln\u011b by m\u011bla b\u00fdt smlouva o \u00faschov\u011b uzav\u0159ena spole\u010dn\u011b s&nbsp;t\u00edmto dokumentem.<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-normal-font-size\">7.&nbsp; Kolik zaplat\u00edm?<\/h2>\n\n\n\n<p>Krom\u011b \u00fahrady kupn\u00ed ceny je t\u0159eba po\u010d\u00edtat i s dal\u0161\u00edmi n\u00e1klady, zejm\u00e9na s<\/p>\n\n\n\n<p>a)\u00a0 proviz\u00ed realitn\u00edmu makl\u00e9\u0159i za zprost\u0159edkov\u00e1n\u00ed koup\u011b nemovitosti obvykle ve v\u00fd\u0161i cca cca 4-5 % z kupn\u00ed ceny;<\/p>\n\n\n\n<p>b) spr\u00e1vn\u00edm poplatkem katastr\u00e1ln\u00edmu \u00fa\u0159adu za pod\u00e1n\u00ed n\u00e1vrhu na zah\u00e1jen\u00ed \u0159\u00edzen\u00ed o vkladu vlastnick\u00e9ho pr\u00e1va aktu\u00e1ln\u011b ve v\u00fd\u0161i 2.000,- K\u010d;<\/p>\n\n\n\n<p>c)&nbsp; n\u00e1klady na \u00fa\u0159edn\u00ed ov\u011b\u0159en\u00ed podpis\u016f na kupn\u00ed smlouv\u011b ve v\u00fd\u0161i 30,- K\u010d za podpis.<\/p>\n\n\n\n<p>Dobrou zpr\u00e1vou je, \u017ee od roku 2020 ji\u017e nen\u00ed t\u0159eba st\u00e1tu odv\u00e9st da\u0148 z nabyt\u00ed nemovit\u00e9 v\u011bci. Tato da\u0148 se zcela zru\u0161ila. Nezapome\u0148te se nicm\u00e9n\u011b informovat o Va\u0161\u00ed povinnosti k platb\u011b dan\u011b z nemovit\u00fdch v\u011bc\u00ed, kterou je povinen platit ka\u017ed\u00fd vlastn\u00edk nemovitosti.<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-normal-font-size\">8.&nbsp; Co d\u00e1l se smlouvou?<\/h2>\n\n\n\n<p>M\u00e1te-li uzav\u0159enou kupn\u00ed smlouvu je t\u0159eba ji nechat zapsat, tzv. zavkladovat, do katastru nemovitost\u00ed. Za t\u00edmto \u00fa\u010delem je t\u0159eba s\u00a0prod\u00e1vaj\u00edc\u00edm sepsat je\u0161t\u011b n\u00e1vrh na vklad vlastnick\u00e9ho pr\u00e1va. Jedn\u00e1 se o formul\u00e1\u0159, kter\u00fd najdete na webu \u010cesk\u00e9ho katastr\u00e1ln\u00edho \u00fa\u0159adu a pom\u011brn\u011b jednodu\u0161e a intuitivn\u011b jej i ve webov\u00e9 aplikaci vypln\u00edte. Formul\u00e1\u0159 vytisknete a spolu s\u00a0kupn\u00ed smlouvou s\u00a0\u00fa\u0159edn\u011b ov\u011b\u0159en\u00fdmi podpisy obou smluvn\u00edch stran jej pod\u00e1te na podateln\u011b\/po\u0161lete po\u0161tou p\u0159\u00edslu\u0161n\u00e9mu katastr\u00e1ln\u00edmu \u00fa\u0159adu. Spr\u00e1vn\u00ed poplatek za pod\u00e1n\u00ed n\u00e1vrhu zaplat\u00edte online nebo uhrad\u00edte v\u00a0pokladn\u011b katastr\u00e1ln\u00edho \u00fa\u0159adu.<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-normal-font-size\">9.&nbsp; P\u0159evzet\u00ed nemovitosti<\/h2>\n\n\n\n<p>P\u0159ed\u00e1n\u00ed a p\u0159evzet\u00ed nemovitosti do Va\u0161eho u\u017e\u00edv\u00e1n\u00ed m\u016f\u017ee b\u00fdt sjedn\u00e1no r\u016fzn\u011b, ale zpravidla se tento krok \u010din\u00ed po vkladu Va\u0161eho vlastnick\u00e9ho pr\u00e1va do katastru nemovitost\u00ed. P\u0159i p\u0159ed\u00e1n\u00ed je vhodn\u00e9 sepsat p\u0159ed\u00e1vac\u00ed protokol. Jeho obsahem by m\u011bl b\u00fdt nejen z\u00e1znam stavu m\u011b\u0159i\u010d\u016f (nap\u0159. elektrom\u011bru, vodom\u011bru apod.), ale tak\u00e9 seznam p\u0159\u00edpadn\u00fdch objeven\u00fdch vad a popis stavu p\u0159ed\u00e1van\u00e9 nemovitosti obecn\u011b. P\u0159ed\u00e1vac\u00ed protokol rovn\u011b\u017e nepodce\u0148ujte, m\u016f\u017ee b\u00fdt d\u016fle\u017eit\u00fdm podkladem pro reklamaci vad nemovitosti.<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-normal-font-size\">10. &nbsp; Koupil jsem zaj\u00edce v pytli?<\/h2>\n\n\n\n<p>Nen\u00ed bohu\u017eel v\u00fdjimkou, \u017ee a\u017e po p\u0159evzet\u00ed a nast\u011bhov\u00e1n\u00ed se do nemovitosti zjist\u00edte, \u017ee nen\u00ed v\u0161e tak r\u016f\u017eov\u00e9, jak V\u00e1m bylo p\u0159i prohl\u00eddk\u00e1ch a n\u00e1sledn\u00fdch jedn\u00e1n\u00edch o koupi prezentov\u00e1no. Rozhodn\u011b nic nepodce\u0148ujte. D\u016fle\u017eit\u00e9 je v\u017edy bezodkladn\u011b jakoukoliv vadu nebo jej\u00ed projev ozn\u00e1mit prod\u00e1vaj\u00edc\u00edmu, a to alespo\u0148 SMS zpr\u00e1vou nebo emailem (jedin\u011b tak m\u00e1te n\u00e1sledn\u011b alespo\u0148 n\u011bjak\u00fd d\u016fkaz o proveden\u00e9 reklamaci). Nejpozd\u011bji m\u016f\u017eete vadu nemovitosti prod\u00e1vaj\u00edc\u00edmu ozn\u00e1mit do 5 let ode dne nabyt\u00ed nemovitosti do vlastnictv\u00ed.
