Nemovitosti jsou specifick\u00e9 v\u00a0tom, \u017ee kupuj\u00edc\u00ed se st\u00e1v\u00e1 vlastn\u00edkem a\u017e po p\u0159episu nemovitosti v\u00a0katastru nemovitost\u00ed na jeho osobu, co\u017e trv\u00e1 nejm\u00e9n\u011b 20 dn\u00ed od podpisu kupn\u00ed smlouvy. <\/p>\n\n\n\n<p>M\u011bl by tedy prod\u00e1vaj\u00edc\u00ed svou nemovitost p\u0159ev\u00e9st do vlastnictv\u00ed kupuj\u00edc\u00edho d\u0159\u00edve, ne\u017e m\u00e1 jistotu, \u017ee kupn\u00ed cena bude kupuj\u00edc\u00edm uhrazena? Kupuj\u00edc\u00ed si naopak t\u00edmto zp\u016fsobem zajist\u00ed, \u017ee se kupn\u00ed cena nedostane k&nbsp;prod\u00e1vaj\u00edc\u00edmu do doby, ne\u017e dojde k&nbsp;p\u0159evodu vlastnictv\u00ed nemovitosti na kupuj\u00edc\u00edho.<\/p>\n\n\n\n<p>          <\/p>\n\n\n\n<p>Pokud se smluvn\u00ed strany rozhodnou vyu\u017e\u00edt p\u0159i prodeji nemovitosti advok\u00e1tn\u00ed \u00faschovu, zpravidla bude postup n\u00e1sleduj\u00edc\u00ed:<\/p>\n\n\n\n<ol start=\"1\" class=\"wp-block-list\">\n<li>uzav\u0159e se smlouva o smlouv\u011b budouc\u00ed;<\/li>\n\n\n\n<li>uzav\u0159e se kupn\u00ed smlouva a smlouva o advok\u00e1tn\u00ed \u00faschov\u011b;<\/li>\n\n\n\n<li>kupuj\u00edc\u00ed slo\u017e\u00ed kupn\u00ed cenu na zvl\u00e1\u0161tn\u00ed \u00fa\u010det advok\u00e1tn\u00ed \u00faschovy;<\/li>\n\n\n\n<li>po slo\u017een\u00ed kupn\u00ed ceny dojde k\u00a0pod\u00e1n\u00ed n\u00e1vrhu na vklad vlastnick\u00e9ho pr\u00e1va do katastru nemovitost\u00ed;<\/li>\n\n\n\n<li>po p\u0159episu vlastnick\u00e9ho pr\u00e1va na katastru nemovitost\u00ed ve prosp\u011bch kupuj\u00edc\u00edho se kupn\u00ed cena advok\u00e1tem vypl\u00e1c\u00ed prod\u00e1vaj\u00edc\u00edmu.<\/li>\n<\/ol>\n\n\n\n<p>   <\/p>\n\n\n\n<p>Pokud by v&nbsp;p\u0159edem stanoven\u00e9 lh\u016ft\u011b nebyly spln\u011bny podm\u00ednky pro v\u00fdplatu kupn\u00ed ceny (nedojde k&nbsp;p\u0159evodu vlastnick\u00e9ho pr\u00e1va, dojde k&nbsp;neo\u010dek\u00e1van\u00e9mu zat\u00ed\u017een\u00ed nemovitosti, exekuci apod.), je advok\u00e1t povinen kupn\u00ed cenu z&nbsp;advok\u00e1tn\u00ed \u00faschovy vr\u00e1tit zp\u011bt kupuj\u00edc\u00edmu.<\/p>\n\n\n\n<p>Podm\u00ednky poskytov\u00e1n\u00ed advok\u00e1tn\u00edch \u00faschov advok\u00e1tn\u00ed kancel\u00e1\u0159\u00ed OK LEGAL naleznete&nbsp;<a href=\"https:\/\/www.legallist.cz\/sluzby\/208\" target=\"_blank\" rel=\"noreferrer noopener\">zde<\/a>.
